Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the first and second respondents not to harass the petitioner and restrain from interfering in the matter to be adjudicated in O.S.No.9460 of 2021 on the file of the XXIII Assistant Judge, City Civil Court at Chennai.

O R D E R

This Criminal Original Petition has been filed to direct the first and second respondents not to harass the petitioner and restrain from interfering in the matter to be adjudicated in O.S.No.9460 of 2021 on the file of the XXIII Assistant Judge, City Civil Court at Chennai.

2. It is the contention of the learned counsel appearing for the petitioner that under the pretext of enquiry, the police is https://hcservices.ecourts.gov.in/hcservices/

unnecessarily harassing the petitioner and interfere with the matter to be adjudicated in O.S.No.9460 of 2021.

3. The learned Government Advocate [Criminal Side] on instructions submitted that on the complaint given by one Ravichandran, petition enquiry is pending before the first respondent.

4. Such being the position, the Investigating Officer has to follow the procedure by issuing notice to the petitioner and on such notice issued, the petitioner shall appear before the Investigating Officer and co-operate with the investigation. If the Investigating Officer finds that if any cognizable offence is made out, he shall proceed as per law.

5. Accordingly, this Criminal Original Petition is disposed of.
