..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the first respondent to act upon the petitioner's claim petitions filed under section 3G(5) of the National Highways Act, 1956 dated 16.09.2024 and 26.09.2024 and to reconsider the Award dated 18.01.2021 and 04.10.2023 passed by the second respondent and enhance the compensation for the petitioner's land measuring 1350 sq. meters in S.No.27/1B, land measuring 80 Sq.mtrs., in S.No.69/1A10B, land measuring 1276 Sq.mtrs., in S.No.28/1A1, Mudukanapalli Village, Hosur Taluk, Krishnagiri District and land measuring 4800 Sq.mtrs. in S.No.421/2 in Mugalur Village, Hosur Taluk, Krishnagiri, in accordance with the provisions

of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and to follow the Section 18 to 27 of the Arbitration and Conciliation Act, 1996.

ORDER

This writ petition has been filed seeking for early disposal of the claim petition pending before the Arbitrator as per the provisions of Section 3G(5) of the National Highways Act, 1956.

2. The petitioner's lands were acquired under the National Highways Act, 1956 and the arbitral claim is pending before the Arbitrator as per the provisions of Section 3G(5) of the National Highways Act, 1956.

3. No prejudice would be caused to any other party if a direction is issued to the first respondent (Arbitrator) to pass the arbitral award under the National Highways Act, 1956, in respect of the lands acquired from the petitioner more fully disclosed in the prayer to this writ petition within a time frame to be fixed by this Court.

4. Learned Standing Counsel appearing for the third respondent, on instructions, would submit that in view of the innumerable cases pending before

the Arbitrator, sufficient time may be granted to the Arbitrator to pass the arbitral award.

5. This Court, after giving due consideration to the submissions made by the learned Standing Counsel appearing for the third respondent, deems it fit to direct the first respondent (Arbitrator) to pass the arbitral award within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. For the foregoing reasons, this Court directs the first respondent to pass the arbitral award in respect of the lands more fully disclosed in the prayer to this writ petition, which were acquired from the petitioner under the National Highways Act, 1956, as per the provisions of Section 3G(5) of the National Highways Act, 1956 and by adhering to the principles of natural justice and following the provisions under the Arbitration and Conciliation Act, 1996, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
