ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Section 6(4) of TN Scheduled Commodities (RDCS) Order, 1982 and Section 7(1) (a) (ii) of Essential Commodities Act, 1955 in Crime No.41 of 2022 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioners are arrayed as A2 and A3 in this case and they were found in possession of 18000 kgs of PDS rice in 360 bags illegally. Hence, the complaint.
3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. He would further submit that a false case has been foisted against the petitioners. Hence, he prays to grant anticipatory bail to the petitioners. 4.The learned Additional Public Prosecutor would submit that totally there are five accused in this case and the petitioners are arrayed as A2 and A3. is not yet completed and if the petitioners are granted anticipatory bail, there is a possibility to tamper the witnesses and hamper the investigation. He would further submit that one previous case similar in nature is pending against the petitioners. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.
5. It is pertinent to note that they were in possession of huge quantity of 18000 Kgs of PDS rice in 360 bags. Therefore, the custodial interrogation of the petitioners are very much required in this case. Considering the circumstances, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
