(Order of the Court was made by P.VELMURUGAN, J.) This Court vide order dated 16.03.2026 dismissed the appeal in O.S.A.No.85 of 2020 as against R3, since no steps have been taken to serve notice on R3. 1/3
Today, the learned counsel for the appellant represented that he has filed the above miscellaneous petition to restore the appeal as against R3, since R3 is a necessary party and is residing in Italy and notice served on R3 and counsel also entered appearance on behalf of R3.
In view of the above submissions and the fact that Mr.Kishore Balasubramanian, learned counsel takes notice on behalf of R3, this Civil Miscellaneous Petition is allowed and the appeal is restored as against R3. List the matter on 23.06.2026 for final disposal. [PVJ] [KGTJ] 16.06.2026 cgi 2/3
