CRIME NO.52 OF2022.

Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify a condition imposed in para 5 (b) the petitioner shall also deposit a sum of Rs. 1,62,200/- (Rupees one Lakh Sixty Two Thousand Two Hundred) to the credit of the Crime No.52/2022 before concerned Magistrate on the file of the before this Hon`ble Court in Crl.OP.NO. 10736 of 2022 and Dated on 05.05.2022 in Cr. No. 52 of 2022 on the file of the respondent police and pass such further or other order and this Hon`ble Court may deem fit and proper in the above stated circumstances and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. S.SENTHILVEL, Advocate for the petitioner and of MR.R.KISHORE KUMAR, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to modify the condition imposed on the petitioner by an order dated 05.05.2022 in Crl.O.P.No.10736 of 2022 to deposit a sum of Rs.1,62,200/- to the credit of the Crime No.52 of 2022 before concerned Magistrate.

2.The case of the prosecution is that the petitioner is incharge of Ichipalayam fair price shop. During inspection, it was found that stock worth about Rs.1,62,200/- was missing. Considering the nature of allegation, this Court granted Anticipatory Bail on condition that the petitioner shall deposit the entire deficit amount. 3.Even though the petitioner deposited a sum of Rs.1,62,200/- on 21.03.2022 to the credit of Consumer's Co-op Wholesales Stores Limited, Salem District in AA033 Kitchipalayam, it was not brought to the knowledge of this Court while granting Anticipatory bail. It is also seen from the acknowledgment produced by the petitioner that the petitioner had paid a sum of Rs.1,62,200/- as early as on 21.03.2022. 4.In view of the above, the condition imposed by this Court on 05.05.2022 in Crl.OP.No.

10736 of 2022 is hereby deleted and a period of two weeks is extended for executing sureties. -sd/- 19/05/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
