Savithiri ..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Certiorarified Mandamus, calling for the records relating to Registration of Cancellation of gift settlement deed dated 25.04.2013 registered as Document No.452/2013 in the office of the Sub-Registrar, Thittagudi, Cuddalore District, cancelling the registered gift settlement deed dated 27.02.2012 registered as document No.189/2012 in the office of the Sub Registrar, Thittagudi, Cuddalore District, and quash the same as unconstitutional, arbitrary and illegal and consequently directing the 1st respondent to forthwith delete the relevant entries relating to registration of cancellation of gift deed in the registration records.

O R D E R

The petitioner seeks for cancellation of a document executed on 25.04.2013. The settlement deed executed in favour of the petitioner by his grandfather has been cancelled under the cancellation of gift settlement deed dated 25.04.2013. The petitioner seeks for cancellation of the aforesaid document dated 25.04.2013.

2.The Registration Department does not have the power to cancel any registered document. The contentions raised by the petitioner in this Writ Petition requires oral and documentary evidence. Therefore, only a Civil Court can adjudicate the dispute raised by the petitioner. This Court expressed the said view to the learned counsel for the petitioner. 3.The learned counsel for the petitioner, on instructions, has now made an endorsement stating that liberty may be granted to the petitioner to approach the Civil Court.

4.In view of the said endorsement, this Writ Petition is disposed of by granting liberty to the petitioner as prayed for. However, there shall be no order as to costs.
