PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the first respondent to not to harass the petitioner.

O R D E R

This Criminal Original Petition has been filed to direct the firstrespondent not to harass the petitioner in the name of enquiry.

2. Heard learned counsel appearing for the petitioner and learned Government Advocate (Criminal Side) for the first respondent.

3. It is also seen that the petitioner has been called for an enquiry with regard to a matrimonial dispute between the petitioner's son and the second respondent. The petitioner's son has filed a petition for divorce before the Sub Court, Poonamallee to dissolve the marriage, which was solemnized between the petitioner's son and the second respondent. Pending the same, the second respondent respondent filed a petition before the Judicial Magistrate, Ambattur under the provisions of the Domestic Violence Act.

4. In the facts and circumstances of the case, there shall be a direction to the first respondent to conduct an enquiry and take further action in accordance with law. It is made clear that if the first respondent finds that it is a matrimonial dispute, the first respondent police shall relegate the parties to approach the appropriate Family Court.

5. With the above direction, this Criminal Original Petition is disposed of.
