The present petition has been filed to direct the respondents to register a case based on the complaint given by the petitioner dated 03.08.2015.
2. The petitioner is the owner of the flat at G-2 Bharathi Apartments, No.9 Abusali Street, Saligramam. Since there was no security to the Apartment, there was a theft of three two wheelers. In order to prevent such thefts, it was decided to fix CCTV Camera to monitor the unknown persons entering into the flat. While so, one Kavitha Nair objected for the same and asked the petitioner to remove the camera. Though she was informed that Camera could be fixed only at the entrance and she can park her vehicle elsewhere, she, with the help of Assistant Commissioner of Police, removed the camera on 02.07.2015. Hence, the petitioner lodged a complaint before the third https://hcservices.ecourts.gov.in/hcservices/
respondent on 03.08.2015. Since no action was taken, the petitioner came forward to file the present petition.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.
4. The learned Additional Public Prosecutor submitted that already a complaint was lodged by the said Kavitha Nair against this petitioner and the petitioner, in order to evade enquiry in the said complaint, has lodged the present complaint. It is his further submission that the petitioner has sent the complaint by post and hence, the petitioner may be directed to give a fresh complaint.
5.Considering the rival submissions, this Court directs the petitioner to furnish a fresh copy of the complaint dated 03.08.2015 in person to the respondent, who shall deal with the same in accordance with law.
