ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

The present writ petition is filed praying for a writ of Mandamus directing respondents to consider the petitioner's representation dated 11.07.2024 requesting the respondents to take necessary action to rectify the erroneous entry in the computer Patta bearing No.190 for the petitioner's agricultural land comprised in Survey No.2/1B1, Asikaadu village, Kuthalam Taluk, Mayiladuthurai District and consequently issue fresh computer Patta bearing No.199 by including survey No.2/1B1, Asikaadu village, Kuthalam Taluk, Mayiladuthurai District.

3. It is submitted by the learned counsel for petitioner that petitioner is the owner of land comprised in Survey No.2/1B1 and had obtained patta bearing Patta No.199. However, on verifying the status of patta online, it was found that the above survey number is now covered by Patta No.190, which was in the 2/5

name of Dhanalakshmi, Wife of Rajamanickam. It is further submitted that the petitioner has submitted a representation to the Revenue Divisional Officer (RDO) for rectifying the above error.

Mr.A.Selvendran, learned counsel for respondents would submit that the RDO would consider the representation made by the petitioner for cancellation and issuance of patta to the petitioner after affording the petitioner, Dhanalakshmi and other interested parties an opportunity of hearing in accordance with law, within the time stipulated by this Court, which was agreed to by the learned counsel for petitioner.

In view thereof, the writ petition stands disposed of with a direction to the appropriate respondent to consider the representation made by petitioner, pass appropriate orders for cancellation of patta and issuance of patta to petitioner in accordance with law, after affording a reasonable opportunity of hearing to the petitioner, Dhanalakshmi and any other interested persons/stake holders, including rival claimants, if any. The above exercise shall be completed by the respondents within a period of twelve (12) weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the 3/5

concerned respondent to consider the representation on its own merits and in accordance with law. No costs.
