ORDER

This writ petition has been filed seeking a direction to the 2nd respondent not to transfer the patta in the name of the 3rd respondent, by considering the petitioner's representation dated 18.03.2026. 2.

The grievance of the petitioner is that the 3rd respondent is seeking for grant of patta in his name for the property more fully described in the affidavit filed in support of the writ petition. According to the petitioner, the 3rd respondent does not have any legal right to obtain patta for the subject property. The petitioner had submitted a representation to the 2nd respondent on 18.03.2026 objecting to the grant of patta in favour of the 3rd respondent. Since the same has not been considered, the present writ petition has been filed before this Court.

Mr. D. Ravichander, learned Special Government Pleader, accepts notice on behalf of respondents 1 and 2. The learned Special Government Pleader, on instructions, submitted that as and when any application is submitted by the 3rd respondent seeking for grant of patta, the petitioner will be heard before passing final orders.

Necessarily, the petitioner has to be heard before considering any application submitted by the 3rd respondent for grant of patta in his name for the property more fully described in the affidavit filed in support of the writ petition.

Since no adverse order is passed against the 3rd respondent, notice to the 3rd respondent is dispensed with by this Court. 6.

This Court is not expressing any opinion on the merits of the petitioner's representation dated 18.03.2026. 7.

Accordingly, this writ petition is disposed of with a direction to the 2nd respondent to issue notice to the petitioner, as and when any application is submitted by the 3rd respondent seeking for grant of patta in his name for the property more fully described in the affidavit filed in support of the writ petition, and only after hearing the objections of the petitioner, the 2nd respondent shall pass final orders on merits and in accordance with law on the application of the 3rd respondent seeking for grant of patta in his name.

With the aforesaid directions, this writ petition is disposed of. No costs.
