ANAND VENKATESH CRIMINAL MISCELLANEOUS PETITION No.6647 of 2022 in Crl.R.C.No.636 of 2022 D.TAMILVADIVU [ PETITIONER ] Vs RAGUPATHIRAJA ERODE [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Suspend the sentence of 6 Months simple imprisonment and fine of Rs.2,00,000/- imposed in Judgement dated 27.08.2018 passed in STC.75/2013 by the Learned Judicial Magistrate, (Fast Track Court No.1) Erode and Confirmed the same in Judgment dated 07.04.2022 passed in C.A.336/2022 by the Learned I-Additional District and Sessions Judge, Erode till disposal of the main Crl.R.C.No.636 of 2022.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S S.RAMAJAYAM, Advocate for the petitioner the court made the following order:- This petition has been filed seeking to suspend the sentence imposed on the petitioner by the Trial Court and as confirmed by the Appellate Court.

2. Taking into consideration the materials available on record and the grounds raised by the petitioner, this Court is inclined to suspend the substantive sentence imposed against the petitioner subject to the following conditions.

(a)To comply with the conditions imposed by this Court in Crl.M.P.No.6649 of 2022, failing which this petition will stand automatically dismissed.

(b)The petitioner shall execute a bond for a sum of Rs.5,000/- (Rupees Five Thousand only) along with two sureties, each for a like sum, and (c)The petitioner shall appear before the learned Judicial Magistrate, Fast Track Court No.1, Erode on the first working day of every month at 10.30 A.M., pending disposal of this Criminal Revision Case.

3. This Criminal Miscellaneous Petition is disposed of accordingly.
