ANAND VENKATESH CRIMINAL MISCELLANEOUS PETITION No.6649 of 2022 in Crl.R.C.No.636 of 2022 D.TAMILVADIVU [ PETITIONER ] Vs RAGUPATHIRAJA ERODE [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to Surrender before the Trial Court to present this Crl.R.C.No.636 of 2022 against the Judgment dated 27.08.2018 passed in STC.75/2013 by the Learned Judicial Magistrate FTC No.1 Erode and Confirmed the same by a Judgment dated 07.04.2022 passed in C.A.336/2018 by the Learned I-Additional District and Sessions Judge, Erode till disposal of the main Crl.R.C.No.636 of 2022.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S S.RAMAJAYAM, Advocate for the petitioner the court made the following order:- This petition has been filed seeking for exemption from surrendering before the Trial Court pursuant to the conviction and sentence imposed against the petitioner being confirmed by the appellate Court.

2. Taking into consideration the materials available on record and the grounds raised by the petitioner, this petition is allowed subject to the following conditions.

"The petitioner shall deposit a sum of Rs.1,50,000/- (Rupees One Lakh Fifty Thousand Only) to the credit of S.T.C.No.75 of 2013 on the file of the learned learned Judicial Magistrate, Fast Track Court No.1, Erode, within a period of four weeks from the date of receipt of a copy of this order. If the amount is not deposited within the time stipulated by this Court, it is left open the Judicial https://hcservices.ecourts.gov.in/hcservices/

Magistrate to issue a Non-Bailable Warrant against the petitioner and secure him to undergo the sentence imposed by the Trial Court and confirmed by the Appellate Court."

3. This Criminal Miscellaneous Petition is disposed of accordingly.
