ORDER : The Court Made the following order :- The petitioners who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 430, 379 of IPC r/w Section 36(A) of Mines and Minerals (Damages & Regulations) Act, in Crime No.185 of 2021, seek anticipatory bail.
2. The case of the prosecution is that the petitioners are alleged to have transported three units of sand in a pond with the help of JCB and transported the same without valid license in a lorry. Hence, the complaint.
3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Therefore, he prays to grant anticipatory bail to the petitioners.

4. The learned Additional Public Prosecutor would submit that the petitioners are habitual offenders and they involved in four, eleven and seven previous cases respectively, similar in nature. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.
5. Considering the above facts and circumstances of the case and also considering the bad antecedent of the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners
