ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 341, 147, 148, 294(b), 392, 397 & 506(ii) IPC in Crime No.329 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with 5 other accused has threatened the defacto complainant and robbed a sum of Rs.2,500/-, Mobile worth of Rs.4,000/- and has also threatened him with knife point. Based on the complaint preferred by the defacto complainant, the First Information Report has been registered against the petitioner and 5 others.
3.The learned counsel for the petitioner submitted that the petitioner was no way connected to the case and he was an innocent. For the statistical purpose, this false complaint has been initiated against the petitioner. He further submitted that he will not abscond and will co-operate with the investigation and trial. 4.The learned Additional Public Prosecutor submits that this is the second anticipatory bail petition and the earlier bail petition filed by the petitioner was dismissed as withdrawn on 17.02.2022 in Crl.O.P.No.3858 of 2022. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5.Taking into consideration the allegations and also the earlier anticipatory petition filed by the petitioner was dismissed as withdrawn on 17.02.2022, this Court is not inclined to grant anticipatory bail to the petitioner.
