Mr.C.Jayaprakash Govt.Advocate For R1 to R4 ND/W -R5 & R6 -Pvt Order This writ petition has been filed to direct the third respondent to cancel the patta, standing in the name of respondents 5 and 6 and consequently issue patta in respect of the property, morefully described in the prayer to this writ petition, within a time frame to be fixed by this Court. 2.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of respondents 1 to 4. On instructions, he would submit that pursuant to the representation given by the petitioner seeking for cancellation of patta Nos.391 & 392, standing in the names of respondents 5 and 6, proceedings have been initiated by the third respondent.
3.In view of the same, no prejudice would be caused to the respondents, if a direction is issued to the third respondent to pass orders, on merits and in accordance with law on the petitioner's application seeking for cancellation of patta Nos.391 & 392 standing in the name of respondents 5 and 6 and for issuance of patta, after giving due consideration to the supporting documents
produced by the petitioner and after hearing the objections of respondents 5 and 6 and any other third party whom the third respondent deems it fit to enquire. 4.Since no adverse order is being passed against respondents 5 and 6, notice to respondents 5 and 6 is dispensed with by this Court. 5.This Court is not expressing any opinion on the merits of the petitioner's representation.
6.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to pass final orders, on merits and in accordance with law on the petitioner's representations seeking for cancellation of patta Nos.391 and 392, standing in the name of respondents 5 and 6 and for issuance of patta in respect of the property, morefully described in the prayer to this writ petition, after giving due consideration to the supporting documents produced by the petitioner and after hearing all the objections of respondents 5 and 6 and also any other third party whom the third respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order.
