Prayer : Petitions filed under Article 226 of the Constitution of India, to issue writs of mandamus, directing the third respondent to consider and pass appropriate orders on the representation of the petitioner dated 12.09.2016 regarding granting special time scale of pay of Rs.1300-3000 + Grade pay of Rs.300 with effect from 15.09.2010, as per G.O.Ms.No.385 Finance (pay cell) Department dated 01.10.2010 and also in the light of G.O.(2D) No.101 School Education Department dated 07.08.2015 with all consequential benefits.
For Petitioners : Mr.S.Selvathirumurugan For Respondents : Mr.T.M.Pappiah, Special Government Pleader COMMON ORDER The petitioners having been appointed as part-time sweepers in the Branch Libraries at Maduramangalam and Govindavadi, Kancheepuram District and they have been working continuously in the Branch Libraries for more than 28/27 years, without getting
the benefit of time scale of pay. It is their further claim that the Branch Libraries at Maduramangalam and Govindavadi, Kancheepuram District have issued certificates to that effect. However, there was no response. Therefore they have given representations to the third respondent on 12.09.2016 through the Branch Librarian, Maduramangalam /Govindavadi, Kancheepuram District (through proper channel) for the purpose of granting the benefit of G.O.Ms.No.385 Finance (Pay Cell) Department dated 01.10.2010 to him. Till date, the third respondent has not passed any order on their representations. Hence, they have sought for direction to pass orders on their representations dated 12.09.2016, regarding the grant of special time scale of pay of Rs.1300-3000 + Grade pay of Rs.300 with effect from 15.09.2010, in the list of the aforementioned Government Orders.
2. Mr.T.M.Pappiah, learned Special Government Pleader, taking notice for the respondents, sought time to consider the petitioners' representation.
3. This Court considering the limited prayer, without going to the merits, here by direct the respondents to consider the pending representations of the petitioners on merits and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order. The writ petitions stand disposed of accordingly. No costs.
