This Civil Miscellaneous Petition has been filed seeking to bring on record the petitioners/proposed appellants 1 to 5 herein as legal representatives of deceased sole appellant.

2. Ms.Jayashree Narasimhan, learned counsel for petitioners submitted that pending Second Appeal, sole appellant died on 04.10.2009. Hence, he has filed the above petition to bring his legal heirs on record.

3. Mr. P.Dhanasekaran, learned counsel for 2nd respondent and Mr.S.N.Selvarajan, learned counsel for respondents 3 and 4 appeared and raised strong objections in allowing the above petition.

4. Considering the facts and circumstances, and being satisfied with the reasons assigned in the affidavit seems to be justifiable one, this petition is allowed. The proposed legal representatives of the sole appellant are impleaded as appellants 1 to 5 in the above Second Appeal.
