2.Heard the learned counsel for the petitioner and the learned counsel for the respondents 1 and 2 and also perused the materials available on record.

3.The learned counsel for the respondents 1 and 2 has no serious objection for allowing this petition.

4.On being satisfied with the averments made in the affidavit filed in support of the petition and the submissions made by the learned counsel on either side, the petition is ordered and S.A.No.572 of 2009 is ordered to be restored.

5.Registry is directed to post the second appeal on 10.1.2022 ''for final hearing''.
