The Petitioner who has been arrayed as the second accused in PRC.No.42/2017, pending on the file of learned Judicial Magistrate, Polur, has challenged the charge sheet. It is the case of the petitioner that the occurrence as well as the injuries sustained itself was improper and that the petitioner has been improperly implicated in the offences.

2. By relying on the accident register and the statement of witnesses, the learned counsel for the petitioner tried to impress this Court stating that the petitioner was not guilty of the offences .

3. In my view, these factual aspects cannot be gone into, for the purpose of quashing the charges. It is always open to the petitioner to raise all these grounds and prove his https://hcservices.ecourts.gov.in/hcservices/

innocence, during the course of trial and arguments.

4. In the result, the Criminal Original petition stands dismissed. Consequently, connected miscellaneous petition is also closed.
