ORDER : The Court Made the following order :- The petitioner, who was arrested for the alleged offence under Sections 148, 307 and 506(2) of IPC and Section 28 of Arms Act, Sections 13, 38, 39 of Unlawful Activities Prevention Act in Crime No.165 of 2022, on the file of the respondent police, seeks bail.
2. The petitioner herein was arrested on 21.02.2022 for the alleged offences under Sections 148, 307 and 506(2) of IPC and Section 28 of Arms Act, Sections 13, 38, 39 of Unlawful Activities Prevention Act. His earlier bail petition was dismissed considering the gravity of the offence and the stage of investigation.
3. The present bail petition is filed on the ground that already 86 days has lapsed and the investigation is almost completed and the custody of the petitioner is no more required. However, the learned Government Advocate (Criminal Side) appearing for the respondent police states that huge amount of ammunition, air rifle, gun and a https://hcservices.ecourts.gov.in/hcservices/
hand cuff were recovered from this petitioner and the source is yet to be ascertained and if the petitioner is released on bail, there is possibility of tampering the evidence.
4. Considering the fact that the investigation is not yet completed, when the gravity of the offence also touches upon the security, peace and tranquillity of the general public, the release of this petitioner on bail at this stage is not conducive, Hence this Criminal Original Petition for bail is dismissed. -sd/- 14/06/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
