Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to direct the learned Judicial Magistrate Court No.II, Chengalpet to permit the petitioners to withdraw the amount a sum of Rs.20,00,000/- (Twenty Lakhs Only) deposited in the credit of Crime No.24/2023 before the learned Judicial Magistrate Court No.II, Chengalpet.

O R D E R

This Criminal Original Petition has been filed seeking a direction to the Judicial Magistrate Court No.II, Chengalpet to permit the petitioners to withdraw a sum of Rs.20,00,000/- (Twenty Lakhs Only) deposited to the credit of Crime No.24 of 2023 on the file of the Judicial Magistrate Court No.II, Chengalpet.

2. On instructions, the learned Government Advocate (Crl.Side) appearing for the first respondent submitted that the defacto complainant, viz., the second respondent herein, has already withdrawn the amount which was deposited by the petitioner to the credit of Crime No.24 of 2023 before the Judicial Magistrate Court No.II, Chengalpet.

3. In view of the above submission, the relief sought for in this petition cannot be granted. Accordingly, this Criminal Original Petition is dismissed.
