Kandasamy v. Soundararajan

C.M.P.No.11642 of 2024 in C.M.A.Sr.No.52625 of 2024 N.ANAND VENKATESH , J This Civil Miscellaneous Petition has been filed seeking to condone the delay of 718 days in filing the Civil Miscellaneous Appeal.

2. The respondents have been served and affidavit of service has also been filed.

3. The second respondent is represented through a counsel. There is no representation for the first respondent either in person or through a counsel.

4. Heard learned counsel on either side.

5. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 718 days in filing the above appeal is condoned.

6. Registry is directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course.

7. Registry is directed to print the name of Mr.C.Paranthaman, learned counsel for second respondent at the time of admission.

It is made clear that for the period of delay of 718 days, the appellant will not be entitled for any interest if in the event of this Court enhancing the amount of compensation fixed by the Tribunal.
