O R D E R

This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.I, Puducherry to dispose the case in C.C.No.282

of 2011 within a time frame.

2. Heard the learned counsel appearing for the petitioner and the learned Public Prosecutor (Pondicherry) appearing for the first respondent and perused the materials available on record.

3. This Court vide order dated 30.09.2024, called for report from the learned Judicial Magistrate No.I, Puducherry regarding enormous delay in not proceeding with the case in C.C.No.282 of 2011. It is stated by the Judicial Magistrate No.I, Puducherry in his report that though sufficient opportunity was given to both the parties, they were not appeared before the court for disposal of the case and final notice was ordered.

4. This Court vide order dated 21.10.2024 directed the learned Public Prosecutor (Pondicherry) appearing for the official respondent to ensure the proper service of final notice to the complainant and the accused for their appearance before the Judicial Magistrate No.I, Puducherry on the next hearing date.

5. Today when the matter is taken up for hearing the learned Public Prosecutor submitted that when the matter came up for hearing on 04.11.2024, both the complainant and respondent appeared before the learned Judicial Magistrate No.I, Puducherry and the copies were also served to them and the matter is ordered to be listed on 12.11.2024.

6. In view of the submission made by the learned counsel on either side, this Court directs the Judicial Magistrate No.I, Puducherry to proceed with the case further and conduct the proceedings in day-to-day basis and dispose the same in accordance with law within a period of six months from today.

7. With the abovesaid direction, the Criminal Original Petition is disposed of.
