Criminal Original Petition filed under Section 482 of Cr.P.C. praying to call for all the records in CC.No.37 of 2017 with respect to RC(A) 37 of 2016 where the petitioners are arrayed as A 10 & A11, pending on the file of the Principal Special Judge for CBI Cases, VIII Additional City Civil Court, Chennai and quash the same by invoking the inherent jurisdiction u/s. 482 of Cr.P.C.

ORDER
Learned Special Public Prosecutor representing CBI submits that an application by the investigating officer has been filed before the Trial Court seeking permission of the Court to conduct further investigation is pending.
In the said circumstances, the present petition to quash the criminal proceedings based on the final report which is subject to the outcome of the application for further investigation, is premature.

Hence, the Criminal Original Petition stands dismissed with liberty to the petitioner to approach this Court if necessary, after the disposal of the application for further investigation pending before the trial Court.
