Respondent Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of certiorarified mandamus calling for the records relating to the impugned order passed by the respondent dated 8.7.2015, and quashing the same and consequently directing the respondent to grant permission to the petitioner to conduct the dance programme which is scheduled to be held on 13.8.2015 at Periya Pavadi Sengunthar Kalaiarangam near Mariamman Temple situate at Vennanthur Village, Rasipuram Taluk, Namakkal District.

By consent, the writ petition itself is taken up for final disposal.

2.The petitioner claims to be the organiser of the temple festival of Sri Mariamman Temple situated at Vennanthur Village, Rasipuram Taluk, Namakkal District, and he submitted an application praying for necessary permission to conduct cultural event being performed by "Chennai Royal Challengers" on 13.8.2015, at 5.00 P.M., and it was rejected by the respondent vide order dated 8.7.2015, and challenging the legality of the same, he has filed this writ petition. 3.The learned Counsel appearing for the petitioner, on instructions, would submit that the petitioner prayed for a larger relief, he may be permitted to submit a fresh application with a https://hcservices.ecourts.gov.in/hcservices/

specific undertaking that in the event of permission being granted to conduct cultural events, no obscenity or vulgarity will be involved and further, there will not be any law and order problem and in that event, the respondent may be directed to consider the application and pass appropriate orders.

4.The Court heard the submissions of Mr.M.Digvijaya Pandian, learned Additional Government Pleader, who accepted notice on behalf of the respondent, also.

5.This Court, in the light of the above facts and circumstances, permits the petitioner to submit an application with a specific undertaking that the conducting of the cultural programme, which includes song and dance programme, will not involve any law and order problem and that no obscenity or vulgarity will be in place, within a period of two weeks from the date of receipt of a copy of this order and the respondent, on receipt of the same, is directed to consider it and pass orders on or before 11.8.2015, and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
