PRAYER : Writ Petition filed under Article 226 of Constitution of India, to issue Writ of Mandamus to direct the respondents to consider the representation of the petitioner dated 10.03.2025 seeking for issuance of level 4 and level 5 certificate of achievement as well as provisional diploma certificate within a stipulated time as may be fixed by this Court. O R D E R

This writ petition is filed for a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 10.03.2025, seeking for issuance of level 4 and level 5 certificate of achievement as well as provisional diploma certificate within a stipulated time.

2. The petitioner is working as a Tailor/HS-2 under Government of India, Ministry of Defence Ordnance Clothing Factory, Avadi, Chennai. The 1st respondent sponsored free Vocational Diploma in welding, 3 years part time course, under National Skills Qualification Framework (NSQF). The said course was jointly presented by the respondents. The petitioner joined the 3 years Vocational Diploma, in welding in the month of January 2014, in the 3rd

respondent college and completed the same in the month of March 2019. The community college of Murugappa Polytechnic college, the 3rd and 4th respondents herein awarded the petitioner a level-3 mark sheet, in the month of August 2015, and level - 4 mark sheet in the month of December 2018 and Level-5 in the month of May 2019. The course completion certificate was also issued on 30.07.2019. The 2nd and 4th respondents issued level 3 certificate of Achievement to the petitioner. However, the petitioner did not receive his level 4 certificate of achievement and provisional certificate. The petitioner approached the college several times for issuance of the provisional certificate, but went in vain. Therefore, the petitioner submitted a representation on 10.03.2025, to the respondents seeking for issuance of provisional diploma certificate. Since there was no response, the petitioner filed the present writ petition.

Though very many grounds have been raised in the Writ Petition, learned counsel for the petitioner submitted that, it would suffice, if this Court direct the second respondent to consider the petitioner's representation dated 10.03.2025, seeking for issuance of level 4 and level 5 certificate of achievement as well as provisional diploma certificate on merits and within a time frame to be fixed by this Court.

4. The learned Additional Government Pleader for the 2nd respondent did not object to the said submission of the petitioner.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Taking into consideration the factual aspects of the matter, this Court without going into the merits of the case, directs the second respondent to consider the petitioner's representation dated 10.03.2025, and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
