ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable u/s 379, 430 IPC and Section 21(1) of Mines & Minerals (Development & Regulation) Act, 1957 in Cr.No.108 of 2022, on the file of the respondent police, seeks anticipatory bail.
2.It is the case of the prosecution that the petitioner is alleged to have transported one unit of savudu sand illegally in a Tractor bearing Registration No.TN 18 W 0814 and he has three previous cases and he is the owner of the vehicle.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in the case and that there is no specific overt act attributed against the petitioner in the First Information Report. 4.The learned Additional Public Prosecutor appearing for the respondent submitted that the quantity of savudu sand involved is one unit and the petitioner is the owner of the vehicle. He further submitted that there are three previous cases pending against the petitioner. However, he vehemently opposed to grant anticipatory bail to the petitioner.
5.Taking into consideration the allegations and also considering the fact that the petitioner is having three previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
