ORDER

This Writ Petition has been filed to direct the first respondent to consider the representation of the first petitioner dated 30.01.2026 and to give police protection for the petitioners to rebuild their house and consequently prevent the

petitioners and their family from respondents 3 to 5 and their hooligans or by any others or by any manner.

2. The case of the petitioners is that the mother of the petitioners purchased the property in S.No.311/2B situated at Karumarapakkam Village, Thirukazhukundram Taluk in the year 1963. After the death of their mother, the petitioners along with their sister are in continuous possession and enjoyment of the property and they also obtained Electricity connection for the said property. While so, the respondents 3 to 5 had created forged documents in respect of the petitioners' property and claimed right over the property. Therefore, the petitioners had filed suit in O.S.No.55 of 2018 and O.S.No. 78 of 2018, which are pending. The further case of the petitioners is that when they attempted to rebuild their house, the respondents 3 to 5, who are habitual offenders are making life threat to the petitioners.

In this regard they had given a letter to the first respondent 27.07.2026 and sent a complaint through registered post to the second respondent on 30.01.2026. However, the first and second respondents have not taken any action against the respondents 3 to 5. Hence, the present Writ Petition.

3. The learned Additional Public Prosecutor appearing for the first and second respondents would submit that on receipt of the complaint, notice has been sent to the persons named in the complaint for their appearance. He

further submitted that in view of the forthcoming general elections, the first and second respondent would conduct enquiry on the complaint of the petitioner after the general election and take action as per law.

In view of the above submissions of the learned Additional Public Prosecutor appearing for the first and second respondents, the petitioners shall appear before the second respondent along with all relevant documents and the second respondent shall conduct enquiry and if the petitioners produced documents to show their ownership, possession and enjoyment of the property, the second respondent shall give adequate police protection to rebuild house in their property and such exercise shall be completed within a period of four weeks after the general elections.

5. With the above directions, this Writ Petition Criminal is disposed of. Consequently, connected miscellaneous petitions are closed. 06-04-2026 Index: Yes/No Speaking/Non-speaking order vrc
