Pushpathal v. P.Saravanagopal
C.M.P.No.15299 of 2024 C.M.P.No.15299 of 2024 in A.S.No.499 of 2024 R.SUBRAMANIAN, J.
and C.KUMARAPPAN, J.
The appellants who are the petitioners seek an order of injunction restraining the respondent from encumbering or alienating the suit property subject matter of the suit in O.S.No.439 of 2018 on the file of the I Additional District and Sessions Court, Tiruppur.
2. The suit filed by the plaintiffs/ petitioners seeking a declaration that the release deed executed by them in favour of the respondent is null and void and for consequential relief of partition has been dismissed by the trial Court. Any alienation pending appeal will be subject to the result of the appeal. Hence, we do not see any reason to grant an order of injunction. Accordingly, this petition is dismissed. We make it clear that the alienation made will be subject to the result of the appeal. (R.S.M., J.) (C.K., J.) 05.11.2024 dsa https://www.mhc.tn.gov.in/judis 1/2
