ORDER

This Criminal Original Petition has been filed seeking a direction to the respondent Police not to harass the petitioner illegally.

2. The petitioner is a history-sheeter in H.S.No.411 of 1999 and that he has been called by the respondent Police to ascertain his movements and also for the purpose of executing a bond, which the petitioner termed as harassment.

3. The learned counsel for the petitioner submitted that petitioner had earlier sought for similar relief in CRL.OP.No.5660 of 2026 and this Court, by order dated 05.03.2026, directed the petitioner to appear before the respondent Police. Pursuant to the said direction, the petitioner appeared before the respondent Police on 12.03.2026 and gave his undertaking. However, the petitioner was again called for by the respondent Police without issuing any summons.

In reply, the learned Additional Public Prosecutor submitted that the petitioner is involved in 42 cases, out of which, 32 cases have been disposed of and 10 cases are still pending against him, including a murder case. It is further submitted that in view of the impending general election, movements of the petitioner, who is a history-sheeter, are required to be kept under watch.

5. Considering the facts and circumstances of the case, this Court is of the view that the petitioner being a history-sheeter, the petitioner can be called by the respondent Police, especially in view of the impending elections and the

same cannot be termed as harassment. However, the respondent Police shall issue summons while calling the petitioner for enquiry.
