ORDER
This writ petition has been filed seeking direction to the respondents to close/relocate/shift the TASMAC wine shop No.2347 located in Kangaiyam Town, based on the representation of the petitioner dated 24.09.2024 and also by considering the map issued by the Surveyor, Kangaiyam, dated 07.02.2025.
2. Mr.M.Sekar, learned Standing Counsel takes notice on behalf of the respondents 1 and 3. Mr.P.Balathandayutham, Special Government Pleader takes notice on behalf of the 2nd respondent.
3. By consent of the parties, the main Writ Petition is taken up for disposal at the time of admission stage itself.
4. The learned counsel for the Petitioner submitted that within 90 metres from the petitioner residence, a TASMAC shop No.2347 is being run by the respondents. That apart, the TASMAC shop is situated few metres away from library, market, Anganwadi school and a Government hospital and 2/6
therefore it is causing disturbance to the general public. In this regard, the petitioner submitted a representation to the respondents on 24.09.2024 praying to close the TASMAC shop. As the same did not evoke any response,the petitioner has come forward with this writ petition seeking for the aforesaid relief.
5. The learned standing counsel appearing for the respondents has stated no objection for disposing of the representation of the petitioner.
6. In view of the limited scope of relief sought for in this writ petition and also in view of the submissions made by the learned counsel appearing on either side, this Court without going into the merits of the case, directs the respondents concerned to consider and pass orders on the representation of the petitioner dated 07.02.2025 on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner. 3/6
