This Writ Petition is filed under Article 226 of Constitution of India seeking Writ of Certiorarified Mandamus to call for the records relating to the Office Notice passed by the 3rd respondent dated 22.03.2017 in his Office Notice No. 1570/SRET/2017-5 and enclosing the Enquiry Report dated 09.03.2017 in reference No. 171/Staff/Enquiry/ 2017 submitted by the 4th respondent quash the same and to direct the 3rd respondent to conduct enquiry by recording the statement of witnesses and affording opportunity to cross examine the witnesses and to produce the defence witnesses and thereafter pass order on the alleged charges dated 30.12.2016.

2. The learned counsel for the petitioner and respondent submit that the Writ Petition is not maintainable in view of the judgment passed by the Hon'ble Supreme Court of India in Army Welfare Education Society, New Delhi Vs. Sunil Kumar Sharma & Ors., reported in 2024 SCC Online SC 1683.

3. The learned counsel for the petitioner submits that the original certificates of the petitioner are lying with the third respondent.

4. The learned counsel for the third respondent would submit that the petitioner shall collect the said certificates at any point of time.

5. Recording the submission made by the learned counsel for the respondents, these Writ Petitions are dismissed. No costs. Consequently, connected miscellaneous petitions are closed. K.SURENDER, J.
