The petitioner seeks for a mandamus directing the first respondent to take action against the 3rd respondent by considering her representation dated 11.12.2017.
2. Heard the learned counsel for the petitioner and perused the said representation of the petitioner.
3. It seems that there is a private dispute between the petitioner and her husband which has culminated into executing https://hcservices.ecourts.gov.in/hcservices/
certain documents by her husband in favour of the other parties. Therefore, it is seen that there is a private dispute between the petitioner and other third parties, over which, certainly the official respondents, namely, respondents 1 and 2, cannot have any role to play. Therefore, the petitioner has to work out her remedy only before the competent Civil Court in a manner known to law and without doing so, filing a complaint before the first respondent to take action against her husband and others in respect of a private dispute is not a proper course of action. Accordingly, I find no merit to entertain this writ petition and thus, the same is dismissed, however, by granting liberty to the petitioner to work out her remedy before the competent Court of law by initiating appropriate proceedings. No costs.
