ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2) & 326(a) of BNS 2023 r/w Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.273 of 2023 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner illegally transported 3 units of gravel sand in a lorry without any valid permission. On seeing the respondent police, the petitioner escaped from the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that the petitioner has two previous cases, similar in nature pending against him. Hence, he opposed the grant of anticipatory bail to the petitioner.

5. In such view of the matter, the petitioner has two previous cases of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.

6. Accordingly, this Criminal Original Petition stands dismissed. 16-04-2026 DRL To 1.The Public Prosecutor, High Court, Madras.
