Respondents Prayer :Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 and 2 to promote the petitioner to the post of driver by granting permission to the approval sought for in Na.Ka.No.764/E/2014 dated 27.05.2014 submitted as per special by-law No.73 by considering his representation dated 18.02.2014, 17.05.2015, 18.05.2015, 04.06.2015, 07.07.2015 and 25.07.2015. O R D E R

The relief sought sought for in this writ petition is for granting permission to the approval sought for through proposal dated 27.05.2014.

2. The learned counsel appearing for the writ petitioner restricting the relief by stating that it is suffice to direct the first respondent to consider the proposal and take a decision on merits and in accordance with the rules. https://hcservices.ecourts.gov.in/hcservices/

3. The writ petitioner is working as a Driver from the year 2006 and his services are not approved and he was unable to get his service benefits in view of the non-approval of his appointment. In this regard, Deputy Registrar (Milk) in his proceedings dated 27.05.2014 submitted the proposals to the first respondent to grant permission, so as to approve the appointment of the writ petitioner. But no decision is taken.

4. Thus the first respondent is directed to consider the proposal submitted by the Deputy Registrar (Milk) on 27.05.2014 and pass appropriate orders on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copy of the representations, proposals along with the order passed in this writ petition.

5. The writ petition stands disposed of. However, no order as to costs. Consequently, connected miscellaneous petition is closed.
