Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the respondents to consider and pass orders on the representation of the petitioner dated 22.06.2015 seeking to pay the petitioner salary from the date of suspension i.e.25.02.2004 till date and to continue to pay salary and all other monetary and attendant benefits.

O R D E R

The relief sought for in this writ petition is to consider the representation submitted by the writ petitioner on 22.6.2015, in relation to the payment of the salary from the date of suspension to the date of revocation of the order of suspension including further payment of salary. https://hcservices.ecourts.gov.in/hcservices/

2. The learned counsel appearing for the writ petitioner states that the petitioner was working as an Office Assistant and he was initially appointed on compassionate ground in the year 2000. On account of certain allegations, the writ petitioner was placed under suspension under proceedings dated 25.02.2004.

3. The writ petitioner moved a writ petition in W.P.No. 413/14 and this Court passed an order, setting aside the order of the suspension on 07.01.2014. Consequently, the writ petitioner was reinstated in service and joined duty on 28.3.2014. However, the salary due for the period in which the writ petitioner was under suspension has not been disbursed. In this regard, the writ petitioner made a representation on 22.6.2015 to the respondents.

4. Without going into the merits of the case, the first respondent is directed to consider the representation submitted by the writ petitioner on 22.6.2015 and pass orders on merits and in accordance with law, within eight weeks from the date of receipt of copy of this order.
