Respondent Prayer:- Criminal Original Petition filed under Section 407 Cr.P.C., praying to issue direction to the Hon'ble Judicial Magistrate Court, Tambaram, to transfer the case in C.C.No.160/2011 to Hon'ble Judicial Magistrate, Chengalpattu and issue further direction to Hon'ble Judicial Magistrate, Chengalpattu to take up the trial of the case and dispose it off within a limited time frame to complete the trial in C.C.No.160/2011 within a period of specified time fixed by the Hon'ble Court.

Heard Mr.J.Muthukumaran, the learned counsel for the petitioner.

2. This petition has been filed for transferring the case from the learned Judicial Magistrate, Tambaram to the learned Judicial Magistrate, Chengalpattu.

3. It is seen that both the Judicial Magistrate, Tambaram and Chengalpattu fall within the Chengalpattu Sessions Division. Therefore, the application filed under Section 407 Cr.P.C. is not maintainable, without the party first moving the application https://hcservices.ecourts.gov.in/hcservices/

under Section 407 (2) proviso. Hence, this Criminal Original Petition is dismissed with liberty to the petitioner to move before the Sessions Court, Chengalpattu.
