PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari, to call for records of the registration of the settlement deed (Document No.2773/2019) dated 31.10.2019 from the third respondent's office and cancel the fraudulent settlement deed registered as Document No.2773/2019 on 31.10.2019 at the third respondent's office.

This writ petition has been filed to call for records of the registration of the settlement deed dated 31.10.2019 and to cancel the same on the premise, it is a fraudulent document.

2. Learned counsel for petitioner relied on the recent decision of the Division Bench of this Court in the matter of M.Kathirvel Vs. The Inspector General of Registration, Department of Registration, 100 Santhome High Road, Chennai - 28 & others in W.P.No.10291 of 2022 etc., batch, wherein it has been held that the Registrar may not have the authority to cancel any deed. Therefore, learned counsel for petitioner

would seek leave of this Court to workout his remedy before the appropriate forum including the civil Court.

3. Accordingly, this Writ Petition is dismissed as withdrawn with a liberty as prayed for. No costs.
