PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to register the court order issued by the Principal District Civil Court, Virudachalam in O.S.No.37of 2006 dated 10.8.2007 and update the land records and encumbrance records accordingly. ORDER

This writ petition has been filed for the issuance of a Writ of Mandamus directing the second respondent to register the judgment and decree dated 10.8.2007 in O.S.No.37 of 2006 on the file of the Principal District Munsif Court, Virudhachalam.

2. Heard the learned counsel for the petitioner and the learned Government Advocate accepting notice for the respondents.

3. The learned Government Advocate appearing for the respondents, on instructions, has submitted that the the said decree was passed in favour of one Mrs.Rajakumari alone, that the petitioner, who claims to be her daughter, wants to register the said decree and that there is no document to establish that the petitioner is the legal heir of the said Mrs.Rajakumari.

4. In the considered view of this Court, the petitioner has to submit before the second respondent a valid document to establish her relationship with the said Mrs.Rajakumari, who is said to have died on 25.8.2018. Once such a document is furnished by the petitioner, there 2/4

are no fetters for the second respondent to register the said decree on payment of necessary charges.

5. With the above observation, the writ petition is disposed of. No costs.
