... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue writ of mandamus to direct the first respondent to dispose the Statutory Revision filed under Section 153 of Tamil Nadu Cooperative Societies Act, 1983, by the petitioner on 06.07.2015 within a stipulated time. For Petitioner :Mr.C.Prakasam For Respondents :Mr.L.P.Shanmuga Sundaram, Spl.G.P.
ORDER
The petitioner has filed the present writ petition seeking for issuance of a writ of mandamus to direct the first respondent to dispose the Statutory Revision filed under Section 153 of the Tamil Nadu Cooperative Societies Act, 1983, by the petitioner on 06.07.2015, within a time frame.
2. Mr.L.P.Shanmuga Sundaram, learned Special Government Pleader, takes notice for the respondents. With the consent of both parties, the writ petition itself is taken up for final disposal.
3. It is seen that the petitioner earlier filed a writ petition being W.P.No.18567 of 2015 seeking a direction to the respondents to disburse the subsistence allowance to the petitioner from 50% to 100%, whereby this Court , by order dated 26.06.2015, https://hcservices.ecourts.gov.in/hcservices/
directed the petitioner to file revision under Section 153 of the Tamil Nadu Cooperative Societies Act before the first respondent within three weeks and on such filing, the respondent was directed to dispose of the said representation as expeditiously as possible. Pursuant to the said order of this Court on 26.06.2015, he filed a revision petition on 06.07.2015, however, it is seen that the petitioner, without giving any time to the respondent, filed the present writ petition, therefore, this Court is not inclined to entertain such prayer of the petitioner in the present writ petition. It is for the petitioner to make an appropriate application before the revision al authority for early disposal of the application.
4. Therefore, for the reasons cited supra, the writ petition fails and the same is dismissed. Needless to state that since the issue is relating to the subsistence allowance, if the revision petition filed by the petitioner is in order, the first respondent is directed to dispose of the same within a period of four weeks from the date of receipt of a copy of this order. No Costs.
