ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 379 of I.P.C, in Crime No.23 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with the other accused were stolen liquor worth about Rs.47,000/-, only part of the stolen good worth about Rs.5000/- were recovered. Hence, the Law Enforcing Agency registered a case against the petitioner.

3. It is seen from the records that this is the second anticipatory bail petition filed by the petitioner. The earlier petition filed by the petitioner in Crl.O.P.No.6356 of 2022 was dismissed on 23.03.2022. He would further submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent condition that may be imposed on him.

4. The learned Additional Public Prosecutor would submit that there is no change of circumstances after the previous order was passed on merits. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the bad antecedents of the petitioner, this Court had dismissed the earlier petition filed by the petitioner and that there is no change of circumstances. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
