ORDER
With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
2. This writ petition is filed to direct the respondents to assign 5 cents of land in S.Nos.822/10 and 822/11 in Pidagam [Elavanasurkottai], Ulundurpet Taluk, Kallakurichi District to the petitioner by considering the representation dated 17.03.2024 given by the petitioner.
3. Heard learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents and perused the materials available on record.
4. The case of the petitioner is that the petitioner was assigned an extent of 4 cents in R.S.No.453/26 in Pidagam Village, Ulundurpet Taluk. The further case of the petitioner is that to the north of the property assigned to the petitioner there is an extent of 10 cents in Natham poromboke S.Nos.822/10 and 822/11 belonging to the Government and it is lying vacant for more than a century. Hence, the petitioner made an application for assigning the said land 2/5
to the petitioner and if the land is assigned to the petitioner, he is ready to pay the sale consideration. In this regard, the petitioner has also filed a Writ Petition in W.P.No.6072 of 2012 and this Court by an Order dated 13.03.2012 directing the respondents to consider the representation of the petitioner within a period of three months. However, the same has not been considered by the respondents. Hence, the present Writ Petition.
5. Considering the limited relief sought for in this writ petition, the respondents are directed to consider the representation of the petitioner dated 17.03.2024 and pass orders on the same on merits within a period of two months from the date of receipt of a copy of this order.
