Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to take necessary action to measure in petitioner No. 2024 / 0123 / 32 / 000216 on 05.01.2024 by the petitioner ancestral property to the extent of 3 Acre 15 Cents at bearing Survey No 861 / B1 of Agalaraipalayam Pudhur Vellakovil Kangeya Taluk Tiruppur district based upon the challan no 2024 / 0123 / 32 / 000216 on 05.01.2024 to the 2nd respondent within stipulated time as fix by this Court.

ORDER

With the consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

2. This writ petition is filed to direct the respondents to take necessary action to measure in petitioner No. 2024 / 0123 / 32 / 000216 on 05.01.2024 by the petitioner ancestral property to the extent of 3 Acre 15 Cents at bearing Survey No 861 / B1 of Agalaraipalayam Pudhur Vellakovil Kangeya Taluk Tiruppur district based upon the challan no 2024 / 0123 / 32 / 000216 on 05.01.2024 to the 2nd respondent within stipulated time as fix by this Court.

3. Heard learned counsel for the petitioner and the learned Special Government Pleader appearing for the respondents and perused the materials available on record.

4. The case of the petitioner is that the subject properties are ancestral properties of the petitioner and he is in peaceful possession and enjoyment of the properties till date. The grievance of the petitioner is that though he has given a petition for measuring the property, the same has not been considered by the respondents till date. Hence, the present Writ Petition. 2/4

5. Considering the limited prayer sought for in the Writ Petition, without going into the merits of this Writ Petition, the respondents are directed to consider the petition of the petitioner dated 05.01.2024 and pass Order on merits and in accordance with law within a period of two months from the date of receipt of a copy of the Order.
