ORDER

The petitioner had participated in the selection process conducted by T.N.Uniformed Services Recruitment Board for appointment to the post of Gr.II Police Constable for the year 2001-02. It is his case that he has successfully cleared all stages, but on medical examination, the doctors, without examining him properly, declared that his vision is defective. Therefore, on the ground of disability, he was not selected. Hence, the petitioner has filed W.P.No.36214 of 2005 before this Court for a direction to conduct second medical examination. On the basis of orders passed in the said writ petition, the petitioner was examined for second time by the medical board and certified that he is not suffering any deficiency in the eyes. Even after such fitness certificate given by the medical board, there was delay in appointing the petitioner, which resulted in the denial of his seniority in the cadre of Gr-II PC. every stage due to the mistake on the part of the medical board, for which, he cannot be faulted. It is the case of the petitioner that he is entitled to get his seniority fixed along with those who were appointed to service in the year 2001-03, with effect from 30.11.2003, based on the marks secured by him. In this regard, the petitioner submitted a detailed representation to the Head of Department, dated 12.01.2019, seeking to revise his seniority in the cadre of Gr-II PC. Since no response is forthcoming on the said representation, the petitioner is before this Court with this writ petition. 2.When the matter is taken up for hearing, the learned counsel for the petitioner seeks a direction to the respondent to dispose of the representation submitted by the petitioner. 3.Mr.J.

Pothiraj, the learned Special Government Pleader, takes notice on behalf of the respondent. 4.Since the prayer in the writ petition is limited in its scope, the writ petition is disposed of with a direction to the respondent to consider and dispose of the representation of the petitioner dated 12.01.2019, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs.
