Order This Writ Petition has been filed to direct the 2nd respondent herein to register and release the Settlement Deed and Release Deed presented by the petitioner.

Learned counsel for the petitioner submitted that the petitioner has purchased a property measuring 627 3⁄4 sq.ft in Old S.F.No.626/1 and T.S.No.279, situated at Kumarapalayam Amani Village, Kumarapalayam Town, Salem Main Road, Ward No.26, Ward B, Block No.7. While so, one Senthamanai, Managing Trustee of J.K.K.Rangammal Charitable Trust, made an attempt to illegally grab the petitioner's property and executed two Sale Deeds in favour of one Murali and his wife Rajalakshmi. Hence, the petitioner filed Objection Petition before the 2nd respondent. After enquiry, the 2nd respondent has not proceeded with the registration. In that regard, the petitioner also filed a Civil Suit against the said Senthamari in O.S.No.396/20256, renumbered as O.S.No.206/2020, pending on the file of the District Munsif, Kumarapalayam.

3. Learned counsel further submitted that due to the petitioner's old age, the petitioner intended to prepare a gift Settlement in favour of her daughter and on the same, the petitioner's father and sister also executed a Release Deed in

favour of her in respect of the said properties. Thereafter, the petitioner presented the Gift Settlement Deed and the Release Deed for registration before the 2nd respondent. However, the 2nd respondent issued two refusal check-slip on the ground that the title was not clearly established and a Civil Suit is pending. Hence, the petitioner filed W.P.No.3353 of 2026, wherein this Court directed the respondents therein to set aside the refusal slip and permitted the petitioner to represent the documents. In compliance of the said order, the 2nd respondent permitted the petitioner to execute the Settlement Deed and the Release Deed. However, the petitioner though presented the Deeds for registration, 2nd respondent without any valid reasons, kept the documents pending. Aggrieved over which, the petitioner has filed this writ petition.

In reply, the learned counsel for the respondents / registrars submitted that in the present case, a similar set of documents had already been filed by the third parties and the same is kept pending and hence, the respondents would conduct an appropriate enquiry into the matter and thereafter take a decision regarding registration of the documents.

5. In such view of the matter, the 2nd respondent Sub Registrar is permitted to conduct an enquiry after issuing notice to all the parties concerned. Upon completion of such enquiry, the 2nd respondent shall take an appropriate decision with regard to the registration of the documents, in accordance with

law. The entire exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.

6. This writ petition stands disposed of with the above observations. No costs.
