This petition has been filed seeking to condone the delay of 1940 days in filing the appeal.

2. Heard the learned counsel for the petitioners.

3. Mr.D.Nithin, learned counsel takes notice for the respondent.

4. The 1st petitioner would aver that her husband died in road traffic accident and she is in financial crisis to run her day to day life. She has spent money for treatment of her husband and for maintaining the family. Hence, the delay of 1940 days occurred in filing the appeal. Meanwhile, due to her financial condition and ill health, the said delay was caused, which is not willfull.

5. Accepting the averments made in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is ordered and the delay of 1940 days is condoned on condition to waive the interest for the delay period.
