When the matter was listed before this Court on 14.02.2018, there was no representation for the appellant. Hence, the matter was ordered to be listed on 16.02.2018. Even when the matter is listed on 16.02.2018, there was no representation on behalf of the appellant. Hence, the Registry was directed to post the matter on 20.02.2018 under the caption 'for dismissal'.

2. Even today (20.02.2018), when this matter is taken up for hearing, there is no representation on behalf of the appellant as well as respondent either in person or through counsel. Hence, the Second Appeal is dismissed for non prosecution. No costs. Consequently, connected Miscellaneous Petition is also closed.
