This Civil Miscellaneous Petition has been filed to declare the 1st respondent as major and discharge the guardian of the 1st respondent.

2. It is submitted that at the time of filing the suit, the 1st respondent was aged about 6 years and the suit was filed by the 1st respondent represented by his guardian one Murugesan who is his maternal uncle. Pending the Second Appeal, the 1st respondent has attained majority in the year 2011.

3. The petitioner/ appellant has come up with the above petition to declare the 1st respondent as major. Notice was ordered to respondents 1 to 3 and the 1st and 3rd respondents has been served and their names are printed in the cause list.

4. The 3rd respondent is the mother of the 1st respondent and a learned counsel has entered appearance on behalf of the 2nd respondent and submitted that he has no objections in allowing the petition.

5. Since, the 1st respondent has become major as early as in the year 2011 and due notice has also been served on him and the his mother, 3rd respondent, this petition is ordered as prayed for.

6. The guardian is discharged from his guardianship. The Registry is directed to carryout necessary amendments and post the appeal on 13.02.2024.
