PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to call for the records in Crime No.1 of 2021 on the file of the first respondent and quash the same.

O R D E R

This Criminal Original Petition has been filed to quash the First Information Report registered in Crime No.1 of 2021 pending investigation on the file of the first respondent for the offences under sections 294[b], 34, 498A and 506[ii] of IPC and Section 3 of Dowry Prohibition Act, 1961.

2. The allegation in the First Information Report is that the family of the husband of the defacto complainant had demanded and extracted money and jewellery from the defacto complainant.

3. The learned counsel for the petitioners would state that there is no specific allegation against the petitioners and all the members of the family were roped in only with an ulterior motive and hence, sought to quash the First Information Report against the petitioners.

Heard the learned counsel appearing for the petitioner and the learned Public Prosecutor [Pondicherry] appearing for the first respondent and the learned counsel for the second respondent.

5. Normally, when general allegations are made against the family members, this Court will be entertaining the petition for quashing the First Information Report. However, on a perusal of the First Information Report, it is seen that serious allegations are made against the petitioners. In such view of the matter, this Court is not inclined to quash the First Information Report at this stage and the first respondent shall conclude investigation and file the final report in accordance with law.

Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
