By consent of both sides, the Writ Petition is taken up for final disposal at the admission stage itself.

This writ petition has been filed for a direction to the respondents to fix the land value of the property in S.F.No.279/1 to an extent of 1803 sq.ft. in Plot No.7 (DTCP approved Plot) at Pachampalayam Village, Annur Taluk, Coimbatore District as per the representation of the petitioner dated 01.11.2023 within stipulated time.

It is the case of the petitioner that originally the properties in S.F.No.279/1 to an extent of 0.36 1⁄2 acre at Pachampalayam Village, Annur Taluk, Coimbatore District belonged to one C.Boopathirajan as per partition deed dated 26.05.2016, who after obtaining proper approval from the competent authority on 01.08.2022 as per G.O.Ms.No.78, Housing & Urban Development (UD4(3)) Department dated 04.05.2017, sold out the same to the petitioner. The petitioner purchased an extent of 1803 sq.ft. in Plot No.7 at Pachampalayam Village, Annur Taluk, Coimbatore District from the said 2/4
C.Boopathirajan vide document No.10921/2022 dated 17.08.2022 and is enjoying the same. It is the grievance of the petitioner that the above said property is regularized and approved layout. But the respondents have not fixed the value of the land. Hence, the petitioner approached the respondents and requested to fix the value of the land. Since no action was taken, the petitioner by representation dated 01.11.2023, requested the respondents to fix the value of the same. Since there is no response till date, the petitioner has come out with this Writ Petition.
4. Heard learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents and perused the materials available on record.
5. It is the contention of the writ petitioner that he has purchased the plot and is also intending to purchase another plot which is unapproved. So in this regard, he wants to know the value of the property and therefore, he seeks a direction to the respondents to fix the value of the property. This Court is of the view that such direction cannot be granted. As the petitioner himself intends to purchase the unapproved plot, as a matter of right he cannot seek fixation of the value.
